Terms of Service and End User License Agreement for HeyBLU apps and services.
Return to HomeThese Terms of Service and End User License Agreement ("Terms" or "EULA") govern your access to and use of the services provided by Big League Ballpark Inc., doing business as HeyBLU ("HeyBLU", "we", "us", or "our"), including our website located at heyblu.ai, our strike zone tracking application, rulebook assistant, and related services (collectively, the "Services").
If you download HeyBLU from the Apple App Store, your use of the app is also subject to Apple's Licensed Application End User License Agreement where applicable, except where this custom EULA applies in App Store Connect. This EULA is between you and HeyBLU only—not Apple.
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.
By accessing or using HeyBLU's Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
HeyBLU provides technology services including:
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice.
HeyBLU is a paid subscription app. Payment is processed by Apple through In-App Purchase. We do not collect or store your payment card details.
HeyBLU is offered at an introductory launch rate. Standard pricing may apply to new subscribers in the future. Prices may vary by country or region based on Apple's App Store pricing tiers. The price shown in the App Store at the time of purchase is the price that applies to your transaction.
HeyBLU is offered with a 14-day free trial on monthly and annual plans through Apple's In-App Purchase system. The App Store and the in-app purchase screen will show the trial length and the price that applies after the trial ends.
Unless you cancel at least 24 hours before a free trial ends, your subscription automatically converts to a paid plan at the price and billing period you selected (monthly or annual). You will be charged through your Apple ID account when the trial period ends. During a trial, you may cancel at any time in your Apple account settings to avoid being charged.
Introductory or promotional subscription pricing may change over time and is always subject to what Apple displays at purchase.
Payment will be charged to your Apple ID account at confirmation of purchase (or at the end of any free trial, if applicable). Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription rate. Any unused portion of a free trial period is forfeited when you purchase a subscription, where applicable.
You can manage or cancel your HeyBLU subscription at any time through your Apple account:
Deleting the HeyBLU app does not cancel your subscription. Cancellation takes effect at the end of the current billing period. You will retain access until that period ends.
Subscription purchases and renewals are handled by Apple. Refund requests must be submitted to Apple in accordance with Apple's policies. We cannot issue refunds for App Store purchases directly.
An active HeyBLU subscription includes live ball/strike calls, estimated pitch speed, saved bullpen sessions, Command Center on a second device, unlimited pitchers per session, session reports (including shareable images), and spreadsheet export with detailed pitch data. We may update which features are included from time to time.
If a subscriber shares their live pitch location feed, non-subscribers with the same HeyBLU app can Follow Game with their own iPhones at no charge. Follow Game data exists only for the active connection—it is not saved after you disconnect. Running a bullpen session, saving sessions, and exports require an active HeyBLU subscription.

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, software, and algorithms, are owned by Big League Ballpark Inc. or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You may not use our trademarks, logos, or other proprietary information without our prior written consent.
If you submit content to our Services (such as questions, feedback, or data), you grant us a non-exclusive, royalty-free, perpetual, and worldwide license to use, modify, and display such content in connection with providing and improving our Services.
The following terms apply to the HeyBLU iOS app obtained through the Apple App Store and are required for our custom End User License Agreement with Apple:
This EULA is concluded between you and HeyBLU only, not with Apple. HeyBLU, not Apple, is solely responsible for the HeyBLU app and its content. Apple has no obligation to furnish any maintenance or support services for the app.
Apple grants you a limited, non-transferable license to use the HeyBLU app on Apple-branded products that you own or control, as permitted by the App Store Usage Rules. You may not distribute or make the app available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute, or sublicense the app except as permitted by this EULA or Apple's rules.
HeyBLU is solely responsible for providing maintenance and support for the app. Apple has no obligation to provide maintenance or support services. For support, contact us at support@heyblu.ai.
HeyBLU is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in Section 10. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
HeyBLU, not Apple, is responsible for addressing any claims relating to the app or your possession and/or use of the app, including product liability claims, failure to conform to legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
In the event of any third-party claim that the app or your possession and use of the app infringes that third party's intellectual property rights, HeyBLU, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with applicable third-party terms when using the app (for example, your wireless data service agreement). The app may include third-party components or services subject to their own terms.
Apple and Apple's subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, error-free, or completely secure. HeyBLU's strike zone tracking and rulebook assistant are tools to aid decision-making during practice and training.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIG LEAGUE BALLPARK INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.
You agree to indemnify and hold harmless Big League Ballpark Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Services or violation of these Terms.
We may terminate or suspend your access to the Services at any time, with or without cause or notice, for any reason, including if you breach these Terms.
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Effective Date" above.
Your continued use of the Services after such changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
